Terms of Service

Welcome to kranky.io. By using our platform, you agree to these terms. We've written them in plain English so you can actually understand what you're agreeing to.

1. Account Terms

You must be at least 13 years old to use kranky.io. If you are between 13 and 18, you must have a parent or guardian's permission. We do not knowingly collect information from children under 13. If we learn we have collected data from a child under 13, we will delete it promptly.

• One account per person. Don't create multiple accounts.
• You're responsible for keeping your account secure. Use a strong password and don't share your login credentials.
• You're responsible for everything that happens under your account, whether you authorized it or not.
• If you suspect unauthorized access to your account, contact us immediately at meow@kranky.io.

2. Service Description

kranky.io provides game server hosting. We spin up and manage dedicated game servers for you on cloud infrastructure so you can play with your friends.

• We aim for high uptime, but we do not guarantee 100% availability. Servers may occasionally go down for maintenance, updates, or unexpected issues.
• Our service is provided on a best-effort basis. We'll do our best to keep your servers running smoothly, but things can and do break sometimes.
• Features and supported games may change over time as we improve the platform.

3. Acceptable Use

Don't use our servers to do anything shady. Specifically, you agree not to:

• Use our servers for any illegal activity, including distributing pirated content or violating any applicable law.
• Launch DDoS attacks or any form of network abuse from our servers.
• Run cryptocurrency miners or any non-gaming workloads on your game server.
• Distribute malware, viruses, or any other harmful software through our platform.
• Exceed the resource limits of your plan (CPU, RAM, disk, network). If you consistently exceed your limits, we'll ask you to upgrade or we may throttle your server.
• Attempt to gain unauthorized access to other users' servers, accounts, or our internal systems.
• Resell or redistribute our services without our written permission.

Violating these rules may result in immediate suspension or termination of your account without a refund.

4. Payment Terms

• Paid plans are billed on a recurring basis — monthly, quarterly, or annually — depending on the billing cycle you choose.
• All payments are processed securely through Stripe. We never store your credit card information on our servers.
• Subscriptions auto-renew at the end of each billing period. You will be charged automatically unless you cancel before the renewal date.
• You can cancel your subscription at any time from your dashboard. Your server will remain active until the end of your current billing period.
• Prices may change. We'll give you at least 30 days' notice before any price increase takes effect on your account.
• We offer a 72-hour money-back guarantee on all paid plans. See our Refund Policy for details.
• After the 72-hour window, no refunds will be issued for the current billing period.

5. Free Trial

• We offer a 48-hour free trial so you can test our platform before committing to a paid plan.
• Free trials are limited to one per user. Creating multiple accounts to get additional trials is a violation of these terms.
• Trial servers are limited to 512MB RAM and 2 player slots.
• We do not guarantee that your server data will be retained after the trial ends. If you want to keep your world, upgrade to a paid plan before the trial expires.
• No payment information is required to start a free trial.

6. Server Data

• Your game server files (world saves, configurations, mods, etc.) are stored on AWS infrastructure.
• While we take reasonable precautions to protect your data, we are not responsible for data loss due to hardware failures, software bugs, or other unforeseen events.
• We strongly recommend making regular backups of your server data using our built-in file manager. You can download your world files at any time.
• When your subscription ends (whether you cancel or it expires), your server data will be retained for 7 days. After that, it is permanently deleted and cannot be recovered.
• If you need your data after cancellation, download it within the 7-day retention window.

7. Intellectual Property

• Your stuff is yours. You retain full ownership of your game worlds, saves, configurations, and any content you create on our platform.
• Our stuff is ours. The kranky.io platform, website, branding, and underlying technology are owned by us. You may not copy, modify, or redistribute any part of our platform.
• Game content (Minecraft, Palworld, Valheim, ARK, Terraria, etc.) belongs to their respective publishers and developers. We are not affiliated with or endorsed by any game publisher.

8. Termination

• By you: You can cancel your subscription and close your account at any time. Your server will remain active until the end of the current billing period.
• By us: We reserve the right to suspend or terminate your account immediately if you violate these Terms of Service. In cases of serious violations (illegal activity, network abuse), we may terminate without warning.
• If we terminate your account for a TOS violation, you are not entitled to a refund.
• Upon termination, your server data will follow the 7-day retention policy described above.

9. Limitation of Liability

kranky.io is provided "as is" and "as available" without any warranty of any kind, whether express or implied.

• We do not warrant that the service will be uninterrupted, error-free, or secure.
• We are not liable for any lost data, lost profits, server downtime, or any indirect, incidental, or consequential damages arising from your use of our service.
• Our total liability to you is limited to the amount you have paid us in the 12 months preceding the event giving rise to the claim.
• This limitation applies to the fullest extent permitted by applicable law.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we'll update the "Last updated" date at the top of this page.

For significant changes, we'll make reasonable efforts to notify you (such as an email or a notice on the website). Your continued use of kranky.io after changes take effect means you accept the updated terms.
